Property Condition, Disclosures and Recommendations

In purchasing a property, buyers will want to receive as much information about the property as they can to make informed decisions. Generally, sellers provide and buyers receive a Seller’s Property Disclosure Statement prior to the purchase agreement being signed. Sellers will also want to inform buyers in writing of any changes and discoveries regarding the property, which may occur before closing but after initial delivery of the Disclosure Statement.

Buyers and sellers should be aware that the seller, not RE/MAX and its Sales Associates, makes the disclosure. Further, the Disclosure Statement does not constitute a contract between the buyer and the seller. It merely provides a disclosure of the seller’s knowledge about the property. Any agreements, representations or warranties between the buyer and seller must be included in the Purchase Agreement.

Homebuyers should be aware of environmental issues, which may effect their buying decisions. Among the most common environmental issues are:

  • Radon
  • Lead based paint/plumbing
  • Hazardous substances
  • Electrical and magnetic fields (EMF)
  • Asbestos
  • Underground storage tanks

For more information about any of these environmental issues, please consult Frank Armstrong.

Recommendation of Professional Inspections

Because purchasing real estate is a major step for anyone, buyers like to know as much about the property as possible so that they can be better informed when making decisions. Therefore, buyers may wish to have a home inspection done. There are various companies, which can provide home inspections.

Recommendation of Home Warranty Programs

Current and prospective owners should be aware that there are companies, which offer home warranty programs. These programs provide coverage of certain home components for a period of time. This can help with the cost of repairs after the warranty if purchased.

Well and Septic

In purchasing a property that has a well and a septic tank, make sure to have the water tested and septic inspected as part of the purchase offer.
